These terms apply to the Structured Email Program and the Ongoing Guidance Program ordered directly from the provider. The programs offer individual advisory and educational guidance in writing. They are not medical diagnosis, medical treatment, psychotherapy, or an emergency service, and do not replace appropriate professional healthcare. No particular health outcome is guaranteed. These terms cover programs purchased by adults aged 18 or over.
2. Programs
Structured Email Program
The program normally includes 8–10 individual email exchanges. The provider’s responses contain explanations, questions, and practical guidance. The final response includes a personal summary and recommendations for next steps.
Ongoing Guidance Program
This follow-up program is intended for clients who have completed the Structured Email Program. It includes one email exchange per month for six months. For both programs, the starting date, expected response times, and any agreed variation in scope or schedule are confirmed by email before payment. Duration depends in part on the client’s replies. Neither program includes unlimited correspondence or immediate replies.
3. Ordering and Contract
Clicking an order button opens a pre-filled email. Sending that email is an enquiry and does not itself create a payment obligation. The provider sends a written offer identifying the program, total price, scope, schedule, payment instructions, these terms, and the Privacy Policy. A contract is formed when the client accepts that offer and the provider confirms acceptance by email. The client receives a copy of the agreed terms by email. Payment is due before the program starts unless otherwise agreed. Before sensitive questionnaire responses are requested, the provider asks for separate explicit consent to the relevant processing of personal data.
4. Prices and Payment
The listed prices are:
- Structured Email Program: USD 190.
- Ongoing Guidance Program: USD 160.
The total amount payable to the provider, including any applicable taxes, is confirmed before the client accepts the offer. No additional provider charges are added without the client’s agreement. Payment may be made through PayPal using the invoice or payment instructions supplied by the provider. Payment processing is subject to PayPal’s applicable terms. The client’s bank or payment provider may charge currency-conversion or other fees under its own agreement with the client. The provider supplies the applicable payment or accounting document. A payment confirmation does not mean that the whole program has already been delivered.
5. Delivery and Participation
After payment is received and any required consent is obtained, the provider sends the introductory questionnaire or instructions within the timeframe agreed in the confirmation email. All program communication takes place by email. The client should use a valid email address, check spam folders, and notify the provider of any delivery problem. The client may take time to reflect before replying. If a delay or interruption affects the agreed schedule, the parties will discuss the remaining work and a reasonable revised schedule. Extensions or additional work require agreement. If the provider cannot deliver the agreed service, the client will be informed and offered an appropriate remedy, including a refund for undelivered services where applicable.
6. Withdrawal and Cancellation
Where statutory consumer withdrawal rights apply, the client may withdraw from a distance contract within 14 days of its conclusion without giving a reason. To withdraw, email info@tomasbrabec.com with a clear statement identifying the client and program. The model form below may be used but is not compulsory.
If the client wants the program to start during the 14-day withdrawal period, the provider obtains a separate express request. If the client then withdraws before completion, a proportionate amount may be charged for services already provided, but only where the relevant legal conditions and information requirements have been met. The right to withdraw is lost following full performance only where the client has expressly consented in advance and acknowledged that this right will be lost upon full performance. Payment alone does not remove withdrawal rights. Any refund due on withdrawal is made within 14 days of receiving the withdrawal notice, using the original payment method unless otherwise agreed without additional cost to the client. After the statutory withdrawal period, requests to stop or pause a program are considered individually. Any agreement on undelivered services will be confirmed by email. Statutory rights concerning defective or undelivered services remain unaffected.

7. Complaints and Disputes
Questions or complaints about delivery or quality should be sent to info@tomasbrabec.com, identifying the program and issue. The provider confirms receipt and addresses the complaint without undue delay. Where Czech statutory consumer complaint rules apply, the complaint is resolved and the client notified within 30 days unless a longer period is agreed. Available remedies depend on the issue and applicable law and may include correction, completion of the service, a price reduction, or a refund. Consumers may seek out-of-court dispute resolution through the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, Czech Republic: https://coi.gov.cz/informace-o-adr/. PayPal’s applicable dispute procedures remain available, but do not replace statutory consumer rights.
8. Privacy and Confidentiality
Personal data are processed as explained in the Privacy Policy. Client correspondence is treated confidentially, subject to necessary service-provider access and applicable legal obligations. Individual responses are provided for the client’s personal use. Sharing material that identifies other people requires appropriate permission.
9. Final Provisions
The contract is governed by Czech law. This choice does not deprive consumers of mandatory protections applicable under the law of their habitual residence. Changes to these terms apply to future contracts. Existing agreements are not changed retroactively without a valid legal basis or the client’s agreement. Individual arrangements confirmed by email form part of the contract. Mandatory legal rights take precedence over these terms.
