1. General Provisions

These Terms and Conditions govern the rights and obligations between the operator and customers in connection with the purchase of:

  • digital products (e-books),
  • online services in the form of structured email programs.

2. Orders and Payment

E-books

  • E-books are sold exclusively through external platforms (e.g., Amazon, Apple Books, Google Play Books).
  • Orders and payments are processed directly on these platforms, in accordance with their own terms and conditions.
  • The operator does not distribute e-books directly and is not responsible for technical issues related to the operation of third-party platforms.

Structured Email Program

  • The program can be ordered through the website www.tomasbrabec.com.
  • Payment and delivery of this digital service are processed through the Gumroad platform (www.gumroad.com), which provides secure payment processing and digital content delivery.
  • All transactions are subject to Gumroad’s Terms of Service (www.gumroad.com/terms).
  • After successful payment, the customer receives a welcome e-mail with a short introductory questionnaire and instructions for sending their first reply.
  • The program proceeds through a series of written e-mail exchanges (usually 8–10), where the operator responds personally to the customer’s answers.
  • This service is tailor-made and cannot be cancelled or refunded once payment has been made.

Ongoing Guidance Program

  • This follow-up program can be ordered through the website www.tomasbrabec.com.
  • Payment and delivery of this digital service are also processed through the Gumroad platform (www.gumroad.com).
  • All payments and possible refunds are governed by Gumroad’s Terms of Service (www.gumroad.com/terms).
  • After successful payment, the customer receives an invitation to send their first monthly update (with a guiding form provided).
  • The program consists of monthly e-mail exchanges for 6 months.
  • This service is tailor-made and cannot be cancelled or refunded once payment has been made.

3. Delivery Conditions

E-books

  • Delivery of e-books is carried out by the respective platform (Amazon, Apple Books, etc.) immediately after purchase.
  • In case of technical issues, the customer must contact the support service of the platform where the e-book was purchased.

Email Programs

  • The program starts immediately after successful payment.
  • The customer receives an initial e-mail with a questionnaire or guidance for the first reply.
  • All further communication takes place exclusively in writing via e-mail.

4. Complaints and Withdrawal

E-books

  • As e-books are sold via third-party platforms, any withdrawal, refund, or complaint must be made in accordance with the rules of the platform where the purchase was completed.
  • The operator is not authorized to handle cancellations or refunds for purchases made through external platforms.

Email Programs

  • Email programs are considered a digital service tailor-made for the customer.
  • Once paid, the service is deemed provided and cannot be cancelled or refunded.

5. Personal Data Protection

  • Only personal data necessary for the provision of services are processed: name, surname, and e-mail address.
  • These data are used exclusively for communication and delivery of the e-mail programs.
  • Data are stored securely and are not shared with third parties, except for service providers directly involved in the delivery of the service (e.g., payment gateway).
  • Personal data are not used for marketing or newsletters without explicit consent.

6. Final Provisions

  • The operator reserves the right to amend these Terms and Conditions.
  • All legal relations are governed by the laws of the Czech Republic.
  • Any disputes may be resolved out of court through the Czech Trade Inspection Authority.
